Terms and Conditions
§ 1 Scope and provider
(1) These Terms and Conditions apply to all orders placed with me through this website by consumers and by businesses.
(2) The provider is Maximilian Sperlich, Hagenmattenstr. 31, 79117 Freiburg im Breisgau, Germany, email krshI27@gmail.com.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(4) Deviating terms of the customer do not become part of the contract unless I expressly agree to them.
§ 2 Formation of contract
(1) The presentation of products on this website is not a binding offer but an invitation to order.
(2) By submitting your order you make a binding offer to conclude a contract of sale.
(3) Receipt of your order is confirmed to you by email without delay. This acknowledgement of receipt does not yet constitute acceptance of the offer. The contract is concluded once I expressly declare acceptance, dispatch the goods, or collect payment, whichever occurs first.
(4) The text of the contract is stored by me and sent to you in text form with the order confirmation. The contract languages are German and English.
§ 3 Prices and VAT
(1) All prices are final prices in euros and are subject to the stated shipping costs.
(2) As a small business within the meaning of § 19 of the German VAT Act, I do not charge VAT and therefore do not state it separately.
§ 4 Payment
(1) The available payment methods are shown to you during the ordering process.
(2) The purchase price falls due for payment upon conclusion of the contract.
§ 5 Delivery, shipping and production
(1) Products are manufactured individually to order by a fulfilment provider and dispatched by that provider directly to the delivery address you specify.
(2) Stated delivery times are approximate. Shipping time is added to production time; both are shown to you before you complete your order.
(3) Shipping costs are stated to you before you place your order.
(4) If production or delivery becomes permanently impossible for reasons beyond my control, I will inform you without delay and refund any payments already made in full.
(5) For deliveries to a country outside the European Union, customs duties, import VAT and handling fees may arise. These are to be borne by you.
§ 6 Retention of title
The goods remain my property until payment has been made in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. The details and the exceptions follow from the Right of Withdrawal notice, which forms part of these terms.
§ 8 Warranty
(1) The statutory rules on liability for defects apply.
(2) Minor, technically unavoidable deviations in colour, trim and paper surface compared with the on-screen representation do not constitute a defect, provided they are customary for printed products and reasonable for you.
§ 9 Liability
(1) I am liable without limitation for intent and gross negligence, and for injury to life, body or health.
(2) In cases of simple negligence I am liable only for breach of a material contractual obligation, the fulfilment of which makes proper performance of the contract possible in the first place and on the observance of which you may regularly rely. In that case liability is limited to the foreseeable damage typical of the contract.
(3) Liability under the German Product Liability Act remains unaffected.
§ 10 Use of the creative tools and rights in artwork
(1) You may use the image-generation tools offered on this website free of charge for private purposes. Commercial use of the generated files requires my prior consent.
(2) Upload only content in which you hold the necessary rights. You indemnify me against third-party claims arising from a breach of this obligation.
(3) I reserve the right to refuse orders whose artwork contains unlawful, harmful-to-minors, offensive or rights-infringing content.
(4) Copyright in the works created by me remains with me. By purchasing a print you acquire ownership of the physical item, but no rights of use or exploitation in the work.
§ 11 Consumer dispute resolution
I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only to the extent that it does not remove the protection afforded by mandatory provisions of the law of the country of habitual residence.
(2) Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
